Condominium Fee Arrears: A Documented Legal Process
From reconciliation to a payment order: tasks, evidence, and important procedural distinctions.
Accurate records and consistent action underpin arrears management. The community benefits when late payments are identified promptly, owners receive clear account statements, and unsuccessful reconciliation leads to documented next steps. The objective is settlement, not public humiliation.
Verify the Balance and the Debtor
Before sending a demand, reconcile assessments, bank receipts, bookkeeping, and corrections. Incorrect references or allocations may explain a discrepancy. The balance should be traceable by period and supported by the relevant resolutions and rules.
Section 24 generally places common-cost obligations on the owner. Agreements with tenants or usufruct holders and obligations toward the condominium require separate consideration; occupancy alone does not identify the debtor. A demand should specify the legal basis, period, amount, payment method, and deadline.
Payment Orders and Mortgages Serve Different Roles
A Hungarian payment order is a notarial procedure for pursuing an overdue monetary claim. Waiting for three months of arrears is not a general prerequisite. Verify the basis, amount, service details, and procedural eligibility first. Issuing an order does not mean the notary has decided the merits after examining evidence.
The debtor generally has 15 days from service to contest the order. Without an objection, it becomes final and enforcement can be requested. A timely objection may lead to litigation over the contested claim. A payment order should therefore not be described as immediately enforceable.
A mortgage under Sections 30–32 secures the claim. The threshold of arrears equivalent to at least three months of common costs belongs to this mechanism. Check authorization and document requirements; registration does not automatically produce payment or an auction.
Assign Responsibility and Keep Evidence
HázÜgyvitel can link an account statement, demand, proof of service, and legal records to one case, together with responsibility and the next deadline. This supports continuity during handovers. Access and owner communications should be limited to information necessary for the task.
Diligent handling improves recovery prospects without guaranteeing full recovery. The debtor’s assets, disputes, and costs also matter. Owners need verifiable information about action already taken and the next justified step.
